GENERAL TERMS AND CONDITIONS OF SALE - PRECONTRACTUAL INFORMATION - WITHDRAWAL
PRE-CONTRACTUAL INFORMATION
With this document, the customer also acquires the pre-contractual information referred to in art. 1 of Legislative Decree 21/14 as well as pursuant to art. 45 et seq. of Legislative Decree 206/05.
Before making the payment, the customer accepts all the legal indications to identify the seller and inform the buyer of the rights enjoyed in compliance with the provisions of the consumer code.
The information provided will then form an integral part of the distance contract or the contract negotiated away from business premises, in the event of confirmation of the order, and cannot be changed except with the express agreement of the parties.
INFORMATION ON PRODUCTS
The characteristics and the price of the various products on sale are available on the site through a dedicated card that indicates the name of the manufacturer and all the main characteristics of the item. The published images (photos) may differ from the original product only in terms of pixel quality. For all products sold, the responsibility of the manufacturer or seller (merchant) applies. In the case of packaged products, the manufacturer or seller (trader) is also responsible for the truthfulness and completeness of the information on the packaging and labels.
SELECTION OF PRODUCTS AND ORDER PROCEDURE
Sending the order from the site has the value of a contractual proposal. For the purchase of products, the customer must complete and send the order form in electronic format, following the instructions and procedures contained on the site. The Customer read the General Conditions and the Privacy Policy and confirm their acceptance. The order request procedure ends with the selection of the desired payment method and the confirmation of order sending through the appropriate button. By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure, made visible on the site with a text box and relative mandatory checkbox. , and to fully accept these General and payment conditions transcribed, in fact expressly accepted by ticking the relevant checkbox (i.e. by placing a check mark in the box containing these general conditions, without which the sale procedure will not continue). He also declares to consent to the processing of his personal data in the manner indicated in the Privacy Policy. This acceptance is communicated to the Customer through an order confirmation email containing these General Conditions, the confidentiality information, the order number, the shipping and billing data, the list of Products ordered total price, including delivery costs and the amount of value added tax (VAT). Upon receipt of the order, the availability of the items in stock for the fulfillment of the order will be checked. In the event that one or more products are not available, the Customer Service will promptly send an email to the Customer who, within the next 12 hours, will have the right to reply to confirm the shipment of any additional products available or cancel it. In case of no reply within this period, the order will be considered confirmed and the available products will be shipped. If only a few products are not in stock, the order will be processed with the available products. In both cases, the amount relating to the missing products will be reversed immediately depending on the payment method chosen.
In compliance with the current legislation of the Italian Republic, the sale of alcoholic beverages is allowed only to consumers who have reached the age of eighteen. The user, who by purchasing alcoholic items, confirms the acceptance of these conditions of sale, declares under his own responsibility that he has the age requirements required by law.
PRICES AND SHIPPING
The prices of the products are inclusive of all taxes and duties. All prices are expressed in Euros. All products are packed with the necessary precautions to receive maximum protection against shocks and temperature changes.
TERMS OF PAYMENT
The Customer can pay the price of the Products and the related delivery costs by credit card, cash on delivery, Paypal and bank transfer.

Credit card: payment will be made only after obtaining authorization from the credit card issuer for the amount equal to the price of the product ordered. The payment order will be transmitted - via a secure connection - directly to the portal of the bank or financial company expressly indicated by the Customer.

PayPal: once the order is confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or using a card, even prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relative conditions. Paypal commission costs are obviously charged to the customer.
TRANSPORT AND DELIVERY
The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate section "addresses" All purchases will be delivered by express courier (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. We are not responsible for unforeseeable delays or those not attributable to it. Once the Products have been shipped, the Customer will receive a confirmation email which will include a link, if available, to refer to for tracking the shipment. In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within an indicative period of at least 7 (seven) maximum 30 (thirty) working days starting from the day following that in which Commerciando has been confirmed. order to the Customer via a specific order confirmation email. The service includes 1 delivery attempt at the address indicated at the time of the order. A notice will be left after the switch. If the recipient is not traceable or is absent, exceeding the storage period allowed by the carrier, the goods will return to the warehouse. The seller is not responsible in case of failure to collect the parcel in storage, which cannot be a reason for complaint and / or refund. In the event that the customer wants the goods not delivered again due to storage and returned to the seller's warehouse, he can request a new delivery (by PEC and / or registered mailer Ar - m. Lauriola@pec.it - Garganomarket - Corso Umberto, 83 - 71018 Vico del Gargano (Fg) no later than 30 days from the return of the goods to the seller) upon payment of other shipping costs. It is understood that the seller will not be in any way responsible for delays in shipments if less than the 30-day deadline provided for by art. 61 paragraph of the Consumer Code.
RIGHT OF WITHDRAWAL - COMPLAINTS
The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except in the cases of exclusion provided for in the following points. To exercise this right, the Customer must send a communication no later than 14 days from the date of receipt of the products, and then return them in the manner described below. In the event that the person making purchases on the Site requests an invoice and / or in any case is not a "consumer or user" as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the rules of withdrawal will not apply, nor, more generally, the provisions that, pursuant to the same Consumer Code, apply only to "consumers". This communication must be sent by registered letter with return receipt, addressed to: Garganomarket - Corso Umberto, 83 - 71018 Vico del Gargano (Fg). The Customer Service, once the communication has been received, will open a file for the management of the return and will communicate to the Customer the instructions on how to return the Products, which will take place by courier indicated by Garganomarket itself.
In case of exercise of the right of withdrawal, Garganomarket will refund the customer the full amount of the returned goods, excluding return costs, within the terms set out below, without prejudice to the right of Garganomarket, to suspend the payment of the refund until the actual receipt of the goods and after checking their integrity (see below). The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In case of bank transfer or cash on delivery, the Customer will be responsible for providing the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).
The Garganomarket Customer Service will, once received the notice of withdrawal, open a file for the management of the return and communicate to the Customer the instructions on how to return the Products which must be sent to the seller's warehouses within 14 days of authorization . The refund will be made within 14 days following the return of the purchased goods, with the following clarifications:

The shipping costs for returning the goods are charged to the customer.

The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer.

Garganomarket is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; therefore no refund will be made if the returned goods do not return to the seller's warehouses.

In case of damage to the goods during transport, Garganomarket will notify the customer of the incident (within 5 working days of receiving the goods in their warehouses), to allow him to file a complaint against the courier he has chosen and obtain a refund of the value. of the asset (if insured). In this case, the product will be made available to the customer for its return simultaneously canceling the request for withdrawal.
The right of withdrawal is totally lost, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where Garganomerket ascertains:

The lack of the external packaging and / or wrapping containing the purchased product;

Damage to the product for reasons other than its transport;
In case of forfeiture of the right of withdrawal, Garganomarket will return the purchased good to the sender, charging the shipping costs to the sender.
If the customer wishes to exercise the right of withdrawal for goods not yet received due to delivery delays depending on the carrier, the refund will be made within 14 days from the moment the carrier is ready to return the delivery to the sender. In case of loss of the package, the 14-day deadline for refunding will run from the 30th day following the departure of the purchased goods.
In addition to the cases indicated above (non-consumer customer and / or requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:

order of products made to measure or clearly personalized;

order of Products that are liable to deteriorate or expire rapidly;

order of sealed Products that cannot be returned for reasons of hygiene or related to health protection and / or that have been opened after delivery.
With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that "risk deteriorating or expire rapidly" include all food products (including wines, spirits and beverages), as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal is applicable only for Products purchased on the Site that can be returned to Garganomarket and put back on the market without endangering the health of consumers (such as for example books, gadgets, tools for kitchen, etc.). If the customer also intends to return goods subject to exclusion from the right of withdrawal (pursuant to art.59 letter b) Legislative Decree 21/2014), Garganomarket will refuse the package and / or will return the Products to the Customer, charging him, in in this case, the new shipping costs.
